Terms of service

These terms cover your Tools for Builders account and every tool you use with it: JobTools, PondTools, RoofTools, PoolTools, LawnTools, CST Tools, Builder Sites and the tools we add later. By making an account or using the tools, you agree to them. If you don't agree, please don't use the service.
Who runs it
Tools for Builders runs the service. Questions about these terms go to sean@pondtools.com.
Early access
The service is in early access. We are still building it, and features will change, break or go away. It is provided as is and as available, without warranties of any kind, including that it will be error free, always available, or fit for a particular purpose. Keep your own copy of anything you can't afford to lose. Each tool lets you download your records from inside it.
Your account
One account signs you in to every tool. Keep your login to yourself and give each person on your team their own. You are responsible for what happens under your account, including what your team does.
Your customers and your website
You are responsible for the information you put in about your customers, the photos you upload, and everything your website says. That means you need the right to collect and keep your customers' details, and you are responsible for telling callers their call may be recorded where the law requires it. Don't use the tools for anything illegal, for spam, or to publish material you don't have the rights to. We may take down content or switch off an account that breaks these rules.
AI features
Some features use AI. The website editor and other AI features use Anthropic's Claude, through Claude Code. The AI receptionist uses ElevenLabs for its voice and Telnyx for phone numbers. Some design tools make pictures with AI image services. AI makes mistakes. Check what it writes or draws before you rely on it, including prices, proposals and anything on your website, and check what the receptionist books.
Credits and payments
Tools without AI are free. AI features use credits from your account, in any tool, and a credit is worth 10 cents. Credits are prepaid and non-refundable, except where the law says otherwise. Stripe handles payments: card details go straight to Stripe and never touch our servers. When your customers pay you through a tool, Stripe processes that payment too, and Stripe's own terms apply. If we start charging for a plan, we will show you the price before you pay.
Your data
Your data is yours. We don't sell it. Our privacy policy says what we keep, who helps us run the service, and how long backups last.
Leaving
You can delete your account at any time from your account page. That asks every tool to delete what it keeps for you too, including any Builder Sites website. Copies in our backups are erased within 30 days. We may suspend or close an account that breaks these terms or puts the service or other people at risk. Where we reasonably can, we will tell you first so you can download your data.
Limits on our liability
As far as the law allows, Tools for Builders is not liable for indirect or consequential losses, such as lost profits, lost work or lost data. Our total liability for any claim is limited to what you paid us in the 12 months before the claim.
Changes
We may update these terms. If a change matters, we will tell you by email or in the tools before it takes effect. The date at the top shows when they last changed.
Governing law
These terms are governed by the laws of the State of Oregon, USA, and disputes go to the courts in Oregon.
